Welcome to Dual Chat! These Terms of Use (“Terms” or “Agreement”) govern your relationship with the Dual Chat Service (referred to as the “Service”) provided by POCKETECH (“us,” “we,” or “our”). It is important that you carefully read and understand these terms as they legally bind you.

Your access to and use of the Service are conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, free trial users, and any other individuals who access or utilize the Service.

By choosing to access or use the Service, you agree to be bound by these Terms and accept all legal consequences that may arise. If you do not agree to the terms and conditions of this Agreement, in whole or in part, please refrain from using the Service.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the Dual Chat application on a device that you own or control, solely for your personal, non-commercial purposes.

1. Types of Subscriptions: We offer various subscription options, including Weekly VIP, Monthly VIP, and Yearly VIP. Each subscription tier provides specific features and benefits, detailed in the app description and subscription page.
2. Free Trials: For certain subscriptions, we may offer a free trial period. Unless you cancel before the end of the trial period, you will automatically be enrolled in the paid subscription plan.

1. Billing and Payment Method: Upon opting for a subscription, your payment will be processed through your Apple Store account. Payment will be charged to your account after you confirm the purchase.
2. Pricing: The price for each subscription tier is displayed within the app and may vary based on your location and any applicable taxes or currency exchange rates.

1. Renewal Process: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
2. Billing for Renewal: Your Apple Store account will be charged within 24 hours prior to the end of the current period, and the subscription cycle will be extended accordingly.

While all amounts paid are non-refundable, certain refund requests for subscriptions may be considered by Dual Chat on a case-by-case basis and granted at the sole discretion of Dual Chat.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Our services are provided with the current technology and conditions. We are not responsible for unforeseen risks or losses caused by factors like viruses, hacker attacks, or system instability.

You must comply with local laws and regulations. You agree not to use the Service to:

• Upload, post, or transmit any content that is illegal, infringing, obscene, threatening, or that violates any third party’s rights.
• Attempt to reverse engineer, decompile, or discover the source code of the Service.
• Use the Service for any commercial purpose without our express consent.
• Interfere with or disrupt the integrity or performance of the Service.

You must comply with local laws and regulations. You agree not to use the Service to:

• Our Intellectual Property: We hold all legal rights, title, and interest in and to our products, including the Dual Chat software, services, trademarks, logos, and all related content. Unauthorized use of our intellectual property is not permitted.
• User Feedback: Any feedback, comments, or suggestions you provide to us regarding the Service (“Feedback”) is voluntary. You hereby grant us a perpetual, irrevocable, worldwide license to use, modify, and incorporate your Feedback into our services without any obligation or compensation to you.

1. The User acknowledges that the Software may not be free of errors and may not meet all requirements. Installation and use are at your own risk.
2. Although Dual Chat is tested with best efforts, it uses database technologies that may crash or become corrupted (data loss). The user is responsible for any loss of data. It is strongly recommended to make regular backups of the database.

To the maximum extent permitted by law, in no event shall POCKETECH LIMITED, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

You agree to defend, indemnify and hold harmless POCKETECH LIMITED and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, arising from your use of and access to the Service, or from your violation of these Terms.

Minors must obtain consent from their guardians to use our product.

1. This agreement becomes effective upon your use of our product.
2. We reserve the right to modify the terms.
3. We reserve the right, at our sole discretion, to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

We reserve the right to modify this Payment Agreement. Any changes will be communicated through the app or via email, and continued use of the service will constitute acceptance of the new terms.

1. POCKETECH owns and licenses all goods and product-related materials (including trademark, patent, trade secret, content, photos, logos, audio, interface design, and framework) featured on this app. They are all protected by Chinese and international copyright legislation.
2. You may not duplicate, reproduce, distribute, transmit, or publish any information in the copyright in any form or by any means without the prior written consent of POCKETECH, whether for business or non-profit purposes. POCKETECH maintains the right to seek legal redress.

These Terms shall be governed and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of law provisions.
