These Terms of Use (“Terms”) govern your access to and use of the Water Eject ‧ Speaker Cleaner mobile application (the “Service”), operated by POCKETECH LIMITED (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Water Eject ‧ Speaker Cleaner is a utility application designed to help remove water and dust from device speakers using specific sound frequencies and vibrations. The Service also includes tools such as a Sound Meter (dB Meter) which utilizes your device’s microphone and camera.

You acknowledge and agree that POCKETECH LIMITED provides this Service “AS IS” and makes no guarantees that the sound frequencies will successfully remove all water or fix existing hardware damage.

• Use at Your Own Risk: You understand that generating high-frequency sounds or strong vibrations is done at your own risk. We are not liable for any damage to your device’s speakers, internal components, or other hardware resulting from the use or misuse of this Service.
• Water Damage: This App is not a guaranteed fix for water-damaged devices. If your device has been submerged, we recommend professional repair.

• Do Not Use With Headphones: The app generates loud, high-frequency sounds. DO NOT use this App while wearing headphones, earphones, or earbuds. Doing so may cause hearing damage or tinnitus.
• Distance: Keep the device speaker away from human or animal ears while the cleaning cycle is running.

Some features of the Service may be available only with a paid subscription.

• Free Trial: We may offer a free trial period. If you do not cancel the subscription at least 24 hours before the trial ends, you will be automatically charged the applicable subscription fee.
• Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Cancellation: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings (on the App Store or Google Play) after purchase. Deleting the app does not cancel your subscription.
• Refunds: Refunds are processed by the respective app store (Apple App Store or Google Play) in accordance with their refund policies. We do not process refunds directly.

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To harm, threaten, or harass others.
• To reverse engineer, decompile, or attempt to extract the source code of the App.

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of POCKETECH LIMITED and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our Service may contain links to third-party web sites or services (e.g., advertisements) that are not owned or controlled by POCKETECH LIMITED. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused by the use of any such content, goods, or services available on or through any such web sites or services.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; OR C) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS (E.G., FIXING A BROKEN SPEAKER).

IN NO EVENT SHALL POCKETECH LIMITED, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE 1 , GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY DAMAGE TO YOUR DEVICE HARDWARE (SPEAKERS, MICROPHONE, ETC.) ARISING FROM THE USE OF THE SERVICE; (iii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.

These Terms shall be governed and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
